General terms and conditions of business
Thank you for the trust you have placed in us. We always strive to prepare solutions agreeable to our guests. Nevertheless, we recommend you read the following general contractual terms carefully.
Object of the agreement
These General Contractual Terms shall regulate the legal relationship between you and SWISS ARTS MANAGEMENT LLC, hereinafter termed “we”. We shall not be the contractual partner for third party services, such as museums, restaurants, etc.
Conclusion of agreement
We shall undertake to organise and carry out the trip you desire pursuant to your booking. The agreement shall come about once the daily flat rate has been paid into our account and the date for the trip has been agreed in writing. Should no agreement be reached on the journey date, we shall repay the sum paid completely.
Services
Our services within the context of the daily flat rate shall include the organisation and costs for vehicle and driver. The driver shall simultaneously assume the role of tour guide. This shall not include the costs for third party services.
Change of destination
One change of destination shall be possible in consultation with us, normally without cost consequences. In the event of especially great organisational expenses, we shall reserve the right to charge a cost share of a maximum of 10% of the daily flat rate per booking change.
Change of the journey date due to weather forecast
One change of the journey date due to a very unfavourable weather forecast shall be possible in consultation with us up to 48 hours before the start of the journey. However, the journey must be carried out within one year. The date of payment shall apply. After this the balance will lapse.
Change of journey date for health reasons
Postponements for health reasons shall normally be possible without cost consequences. We shall reserve the right if necessary to request a doctor's certificate. Please inform us as soon as possible if you are unable to travel.
Cancellation by the gues
Should the guest be unable or does not wish to make the journey for reasons other than those mentioned above and is unable to provide a substitute, he shall waive his rights. In this case reimbursement shall not be possible.
Cancellation at short notice by the passenge
Should our vehicle already be on the way to the passenger at the time agreed, the journey shall at all events be regarded as embarked upon. A right to reimbursement shall then no longer exist.
Passengers
The passengers to be transported must be stated at registration. Changes must be reported to us as early as possible.
Vouchers
Voucher shall be valid for one year. The date of payment shall apply. Vouchers shall be transferable in consultation with us. Reimbursement shall not be possible.
Prices
The prices at the time of booking shall apply for our services. We shall not assume any responsibility for third parties (admission fees, etc).
Terms of payment
The daily flat rate for our services must be paid before commencing the journey. The client must pay the costs for third party services - unless otherwise agreed - on the spot.
Journey cancellation by the travel organiser
Should the organiser be unable to carry out the journey agreed, especially for technical or health reasons, at the time agreed, the guest may choose whether to make the journey at a later date or request repayment of the sum paid. There shall be no obligation for additional damages.
Luggage
In the case of hybrid vehicles, even very large ones, the boot capacity is limited. Carrying hand luggage is no problem. Larger luggage items must be reported before starting the journey, so that we can clarify the capacity. SWISS ARTS MANAGEMENT shall not transport any goods which cannot be properly stored in the vehicle. Costs arising in this regard must be borne by the passenger. There shall be no obligation to pay damages or a right to reimbursement of the passenger or of reduction of the journey price.
Rollator
We have a modern rollator that fits in the boot of our vehicles and which we would be pleased to put at your disposal. If necessary, please contact us.
Insurance
As a professional service provider, SWISS ARTS MANAGEMENT has comprehensive insurance cover.
Liability
Should it not be possible to carry out a journey as planned through our fault or due to unforeseen grave incidents, we shall after consultation offer a free replacement journey or a proportional reimbursement of the passenger fare. Additional damages shall be excluded.
Damage
The passenger or his liability insurance must pay for damage he causes intentionally or unintentionally to our property, namely to our vehicle.
We or our insurance shall assume responsibility for damage caused by employees of SWISS ARTS MANAGEMENT to the property of passengers.
Smoking
Smoking is strictly forbidden in our vehicules.
Animals
Animals are not allowed in our vehicules.
Data protection
SWISS ARTS MANAGEMENT shall not pass on any personal data on its guests to third parties.
Severability clause
The invalidity of individual provisions of the travel agreement shall not lead to the invalidity of the agreement as a whole.
Translation
In the event of disputes, the German-language version shall be decisive.
Applicable law and place of jurisdiction
Swiss law shall apply exclusively to the legal relationship between you and SWISS ARTS MANAGEMENT.
The place of jurisdiction, Einsiedeln, shall apply exclusively for law suits against SWISS ARTS MANAGEMENT. We may take legal action against the consumer optionally at its place of residence or in Einsiedeln.
Einsiedeln, 1 May 2012
